Employment Restrictive Covenants

Check that the employer and employee have actually signed up to the terms of restrictive covenants

So often, the employer never actually included the relevant term in the employment contract

Perhaps the employee never signed up to a new version of the terms and conditions, or the restrictive covenants are contained in a staff handbook which has no contractual status.

An employer should review the position when considering wage increases and make sure that the pay increase is given in consideration of newly re-stated restrictive covenants.
