Employment: Compromise Agreements

If you are involved in a situation which may require a compromise agreement, work through the following checklist to ensure you have all the relevant documentation to make the most of your meeting with a solicitor:
- Passport and utility bill for money laundering purposes
- Contract and correspondence re terms of employment
- Any employment handbook setting out benefits
- Any pension information
- Any contractual dismissal, disciplinary or grievance procedures and if initiated, copy correspondence
- Cheque book / credit card to pay the fixed fee!
- A history of the relationship (or we can get the facts down at the meeting) to include the interview, appointment, duties, relationships with superiors peers and subordinates and the eventual deterioration of any of those relationships
- Schedule of contractual benefits enjoyed
- Curriculum Vitae (CV) listing education, qualifications and experience
- Statement of potential future employment
Our Approach
We typically create a compromise agreement as a result of a 1 – 2 hour meeting with clients. Our approach is to consider the following:
- Ascertain reasons for termination. Is there wrongful dismissal, genuine redundancy, sham redundancy, unfair dismissal, discrimination or harassment of any sort?
- Ascertain your chances of gaining new employment
- Calculate statutory redundancy pay
- Calculate any damages for wrongful dismissal
- Consider the compensation package and whether its constituent elements are taxable or non-taxable- notice pay, bonuses or commission, refund of expenses, unpaid holiday pay, pension contributions, private health insurance, car, telephone, outplacement services
- Consider chances of success of any claim to the Employment Tribunal. Take into account costs, timetable and stress levels to you
- Draft letter to employer indicating inadequacies of package; determination to take matter to the ET or accepting the package
