Harassment
You are living together and you argue a lot.
Sometimes,
it gets out of hand and he (or she. but I shall assume that you
are a 'she' and the other half a 'he') gets violent, verbally
and some times physically. Once, the police were called. Another
time, you had hospital treatment.
You have tried counselling and mediation - it does not work
for you. You cannot afford to leave ö all the money is tied up
in the house.
What can the Court do? Make an Occupation Order to exclude him
from the house! A power of arrest can be attached to the Court
Order. If he disobeys it, he risks jail. This is serious stuff,
so you will need to persuade the Judge that you are not exaggerating
- hence we need the police and medical reports
If things are urgent, the Court can do this without hearing
him, although he will be given an opportunity later to give an
explanation.
Sometimes, a solicitor's letter is enough to bring him to his
senses
How much does this all cost? You might be entitled to public
funding (legal aid). Alternatively, go 'private'. A consultation
of 1-2 hours, producing a witness statement setting out your situation
and a letter is likely to cost £420.
If this does not work, an application to the Court and one hearing
might cost another £950. Pay it on credit card and claim the cost
against him
