Ante–Nuptial Agreements

Pre-nups may, in many circumstances, be extremely useful in persuading a divorce judge that he should divide up a divorcing couple’s assets in the way that they had already previously considered, investigated and agreed - with the benefit of legal advice.

They are particularly helpful to an older couple, marrying for the second time, with children from their first marriages and their own individual property and other assets.

They are also a valuable tool to concentrate the minds of an engaged couple on what they want to happen if one of them should die or become physically or mentally ill - and often go hand in hand with Lasting Powers of Attorney and Wills.

Through discussions with each other, each party expresses their expectations of their future together and solutions for the unexpected can be considered and agreed.

Setting up an agreement will trigger a full financial review, including an appraisal of policies in force (or not) to protect the couple, and their families, in case of death, critical illness, medical insurance and mortgage protection.
