Separation
Have you and your spouse come to the conclusion that your marriage has broken down?
If so, we imagine that you have many questions. For example, how will this affect the children, what happens to the family home and what am I entitled to?
There are many issues to consider and it is important to know where you stand legally. We appreciate that this is a very difficult time and are here to explain the options available to you.
There are alternatives to a divorce which will need to be considered. If you are not ready to deal with a divorce it may be advisable to enter into a Deed of Separation to deal with the finances of the marriage.
However, the divorce court will look at the finances at the date of hearing, not when the parties separated. It can take the Deed and the financial circumstances at separation into account, but is not bound by them
In relation to the finances of the marriage, we have extensive experience in looking at ways to make the capital, borrowing capacity and income funding just one household stretch to fund two households.
If there is reason to believe that your spouse's declared income does not match his/her expensive life style we may need to consider raising allegations of Îdodgy accounts', cash dealings, hidden assets and offshore bank accounts.
